1. Scope and provider

These terms govern the use of the online game LittleShelf — via the website, as an installed web app, and as a Discord Activity. The provider is the person or company named in our Legal Notice.

Conflicting terms of the user do not become part of the contract unless we expressly agree to them.

2. Formation of the contract

The contract comes into effect when you create an account and accept these terms. There is no entitlement to have a contract concluded.

3. Minimum age

Use is permitted from the age of 16. Younger persons may use LittleShelf only with the consent of a parent or guardian.

A higher age limit applies to paid offers: in-game currency may only be purchased by persons of full legal capacity aged 18 or over — see section 7.

4. Your account

  • One account per person as a rule.
  • Keep your credentials secret and do not pass them on.
  • Your details must be accurate; update your e-mail address if it changes.
  • Tell us immediately if you suspect unauthorised access.

5. Rules of conduct

The following are prohibited in particular:

  • unlawful, insulting, threatening, discriminatory, pornographic or otherwise harmful content in names, chat or submissions;
  • advertising, spam and chain messages;
  • bots, scripts or other automation, and exploiting software defects for your own advantage;
  • attacks on the technical infrastructure, in particular attempts to overload it or to circumvent security measures;
  • trading accounts or in-game content for real money outside the channels we provide;
  • impersonating another person.

6. Game content and virtual items

All game content — items, in-game currency, progress, leaderboard positions — is not property and not a thing in the legal sense. You receive only a simple, non-transferable right to use it within the game and for the game's lifetime. There is no claim to a payout, an exchange, or the continued existence of any particular content.

We may change game content, rules, probabilities and economic values where this is necessary for operation, game balance or legal reasons, and remains reasonable for you.

7. Paid offers

LittleShelf is free to play. You may optionally purchase in-game currency. Payment is handled by PayPal, whose terms apply in addition.

Prices: All prices shown are final prices. Under the small-business rule of § 19 UStG (German VAT Act), no value added tax is charged or shown.

Age: In-game currency may only be purchased by persons of full legal capacity who are at least 18 years old. This applies regardless of the fact that the game itself may be used from the age of 16 (see section 3): payment runs through PayPal, and a PayPal account requires legal adulthood under PayPal's own terms.

Purchased currency is credited to your account once payment succeeds.

8. Right of withdrawal for digital content

As a consumer you have a statutory right of withdrawal when buying in-game currency. In-game currency is digital content not supplied on a physical medium, which brings two particularities worth knowing:

  • The period runs from the conclusion of the contract, not from a delivery — nothing is shipped.
  • The right can expire early if you consent to immediate performance. The exact conditions are set out below under "Early expiry".

Withdrawal instructions

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Early expiry of the right of withdrawal

For a contract on the supply of digital content not supplied on a physical medium, your right of withdrawal expires early once we have begun performance after you have

  1. expressly consented to us beginning performance before the withdrawal period has expired,
  2. confirmed your awareness that by giving that consent you lose your right of withdrawal once performance begins, and
  3. received from us a confirmation of the contract on a durable medium (§ 312f German Civil Code).

All three conditions must be met. If any one of them is missing, your right of withdrawal remains.

End of withdrawal instructions

We obtain the consent and confirmation under points 1 and 2 during checkout, and send the contract confirmation under point 3 by e-mail.

9. Content you submit

You may submit item suggestions and other content. The following applies:

  • You warrant that you hold the necessary rights and infringe no third-party rights.
  • You grant us a simple, worldwide, perpetual, royalty-free right to use, reproduce and make the content publicly available within the game and for promoting it.
  • We may review, reject or subsequently remove submissions. There is no entitlement to inclusion in the game.
  • Image generation transmits your text to an external service — see our Privacy Policy.

10. Availability

We aim for trouble-free operation but do not owe any particular level of availability. Maintenance, faults and events outside our control may cause interruptions. We announce planned maintenance where possible.

11. Suspension and termination

You may delete your account at any time without giving reasons. We may terminate the contract with 14 days' notice; the right to terminate without notice and to suspend an account immediately for serious or repeated breaches of section 5 remains unaffected.

If we are responsible for a suspension, we refund amounts already paid for services not yet used, on a pro rata basis.

12. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For simple negligence we are liable only for breach of material contractual obligations — those whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely — and limited in amount to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.

13. Changes to these terms

We may amend these terms where required for legal or technical reasons or because the game develops further. We will notify you of changes at least six weeks before they take effect, by e-mail or in the game. If you do not object within that period, the changes are deemed accepted; we will point this out separately in the notice. If you object, either side may terminate the contract as of the date the changes take effect.

14. Final provisions

German law applies. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. If any provision is invalid, the remainder of the contract stays in force.

If you wish to withdraw from the contract, you may fill in this form and send it back to us. It is not obligatory — an informal, unequivocal statement will do just as well.

15. Binding version

This page is a translation provided for convenience. In case of any discrepancy, the German version is the legally binding one.
